1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Oils Companion ("we", "us", "our") governing your access to and use of the website https://www.oilscompanion.com and the My Oils Home Companion application (collectively, the "Service"). By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility & Accounts

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement.

You are responsible for:

• Providing accurate and complete information during registration;
• Maintaining the confidentiality of your password;
• All activities that occur under your account;
• Notifying us immediately at hello@oilscompanion.com of any unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. The Service

Oils Companion provides a web-based platform for managing essential oil collections, following wellness routines, and accessing educational content. Features include oil inventory tracking, AI-powered blend suggestions, guided protocols, daily inspiration, and community recipes.

We offer a free tier with core functionality and optional paid tiers (Pro, Family, and one-time product purchases) with additional features. Availability of features may vary by plan.

We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where feasible.

4. Subscriptions & Billing

Paid subscriptions ("Pro" or "Family") are billed monthly or annually in US dollars through Stripe, our payment processor. By subscribing, you authorize recurring charges to your payment method until you cancel.

• Pricing: current prices are displayed on our pricing page. Prices are in USD and exclude applicable taxes.
• Free tier: all accounts start on a free tier with core functionality at no cost. Paid features are unlocked by subscribing or by one-time purchase — there is no automatic trial period.
• Auto-renewal: subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• One-time purchases: certain features (such as the Protocol Library) may be offered as one-time lifetime purchases. These are non-recurring.
• Price changes: we may change subscription prices with at least 30 days' notice. Changes do not affect the current billing period.
• Failed payments: if a payment fails, we may retry the charge and suspend access until payment succeeds.
• Taxes: you are responsible for any applicable sales tax, VAT, or other taxes.

5. Cancellation & Refunds

You may cancel your subscription at any time from the "Billing" section of your account settings, or by emailing hello@oilscompanion.com. Cancellation takes effect at the end of the current billing period; you retain access until then.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws;
• Attempt to gain unauthorized access to any part of the Service, accounts, or systems;
• Scrape, crawl, reverse-engineer, decompile, or otherwise attempt to extract source code;
• Use the Service to generate, store, or transmit malware, spam, or harmful content;
• Impersonate any person or entity, or misrepresent your affiliation;
• Resell, sublicense, or commercially exploit the Service without written permission;
• Use automated systems (bots, scripts) to access the Service in a way that disrupts service for others;
• Abuse the AI features (excessive queries, attempts to bypass safety filters);
• Upload content that is defamatory, obscene, infringing, or that violates another person's rights.

7. User Content

You retain ownership of all content you submit to the Service (oil inventory, routines, notes, reviews — "User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process it solely to operate and improve the Service.

You represent that your User Content does not infringe any third-party rights and complies with applicable law. We may remove any content that violates these Terms.

8. AI-Generated Content

The Service uses artificial intelligence (Anthropic Claude) to generate routines, recipes, blend suggestions, and daily inspiration. AI-generated content:

• Is provided for informational and wellness purposes only;
• May contain inaccuracies and should not be relied upon as professional advice;
• Is not medical advice — see our Medical Disclaimer;
• Should be evaluated using your own judgment and in consultation with qualified professionals.

You are solely responsible for any actions you take based on AI-generated content.

9. Intellectual Property

The Service, including all software, design, logos, text, graphics, protocols, recipes, and compilations, is owned by Oils Companion and is protected by United States and international copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service strictly in accordance with these Terms.

You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written permission.

Oils Companion is not affiliated with, endorsed by, or sponsored by dōTERRA, Young Living, or any other essential oil brand mentioned on the Service. All trademarks are the property of their respective owners.

10. Affiliate Disclosure

Certain links on the Service (particularly in blog articles and the "Join doTERRA" page) are affiliate referral links. If you enroll in doTERRA through one of our links, we may receive a commission at no additional cost to you. This does not influence our editorial independence. All affiliate relationships are disclosed where applicable.

11. Third-Party Services

The Service integrates with third-party services (Stripe for payments, Anthropic for AI, Resend for email, Railway for hosting). Your use of these services is subject to their own terms of service and privacy policies. We are not responsible for the availability or content of third-party services.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free;
• Results obtained from the Service will be accurate or reliable;
• The quality of any information, products, or services obtained through the Service will meet your expectations.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, in no event shall Oils Companion, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service;
• Unauthorized access, use, or alteration of your transmissions or content.

Our total liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages, so the above limitations may not fully apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Oils Companion and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any User Content you submit.

15. Termination

We may suspend or terminate your account at any time, with or without cause, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.

You may terminate your account at any time by contacting hello@oilscompanion.com or using the account-deletion feature in settings. Upon termination, your right to use the Service will immediately cease.

16. Arbitration & Class Action Waiver

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small-claims court if your claims qualify.

• The arbitration will be conducted in English, in the State of Delaware, United States, or remotely at the arbitrator's discretion;
• The arbitrator's decision will be final and binding;
• Judgment may be entered on the arbitrator's award in any court of competent jurisdiction.

CLASS ACTION WAIVER: You and Oils Companion agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class-action lawsuit or class-wide arbitration.

30-day opt-out: you may opt out of this arbitration clause by sending written notice to hello@oilscompanion.com within 30 days of first accepting these Terms, including your name, email, and a clear statement of intent to opt out.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Subject to the arbitration clause above, any legal action shall be brought exclusively in the state or federal courts located in the State of Delaware, United States, and you consent to the personal jurisdiction of those courts.

18. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date at the top of this page indicates when changes were made. Material changes will be communicated via email to registered users at least 30 days in advance. Your continued use of the Service after a change constitutes acceptance of the new Terms.
